Contractors bidding on City of Dallas contracts may discover that they are required to reach out to Minority and Woman Owned Business Enterprises (MBE/WBEs).
The formal name for the MBE/WBE requirements in Dallas is Business Inclusion and Development (BID) Plan, which applies to projects over $50,000 in estimated value. The Program sets the following MBE/WBE participation goals for any BID plan qualifying project:
General contractors are required to make a "good faith effort" to meet these MBE/WBE participation goals and must document their efforts to do so. Credit towards these BID plan goals is only acquired through the participation of MBE/WBEs located within Dallas County. Participation of MBE/WBEs outside of Dallas County are not counted toward the participation goal but are accepted as evidence of a good faith effort.
The documentation included with the packet of bid forms issued by the city of Dallas includes a mix of forms that must be submitted as either part of the ongoing "good faith effort" once the project is under way or before the project is awarded. Of the latter type, please note the Business Inclusion and Development Affidavit that must be turned in with a general contractor’s bid packet.
Additionally, if a general contractor is the apparent low bidder and the BID Plan participation goals cannot not be met, a general contractor must submit a Business Inclusion and Development Documentation Form that details their "good faith efforts" to meet the goals.
Finally, if a general contractor is the apparent low bidder, it needs to complete the Subcontractor Intent Form and have all MBE/WBE subcontractors, suppliers or sub-consultants included in its bid also complete the same document. All MBE/WBE primes, subcontractors, suppliers and sub consultants are required to maintain their certification for the entire duration of the contract.
