Complying with Virginia DOT's DBE good faith effort requirements

Construction companies bidding on contracts with the Virginia Department of Transportation (VDOT) may occasionally have to perform a good faith effort to achieve disadvantaged business enterprise (DBEs) participation goals on a contract. 

Most of the good faith effort steps for VDOT contracts are similar to those outlined by other state's transportation departments. For example, bidders must solicit potential DBE subcontractors and suppliers through advertising, written notices such as fax and/or email, and follow up telephone solicitations. 

There is, however, one aspect of VDOT's good faith effort that differs from others: Prime contractors must solicit DBEs no less than five days before the contract's bid date to demonstrate that they are soliciting DBEs in good faith.
