Washington adopts new MWBE rules

Washington's Office of Minority and Women's Business Enterprises (OMWBE) has adopted revised rules regarding the certification of small businesses owned by minorities, women, and other socially and economically disadvantaged persons (MWBEs).

The first rule change eliminates the requirement that applicants for MWBE certification or recertification notarize their forms. Instead, they are now required to provide a signed declaration. According to the OMWBE, the purpose of this change is to save small businesses time and money.

The new rules also update the personal net worth limit for MWBE applicants from $750,000 to $1.32 million, in order to ensure the applicant is economically disadvantaged.

Also, in an effort to prevent businesses from restructuring ownership and control for the sole purpose of certification, applicants must wait 12 months before reapplying if an application for certification is denied.

Other rule changes include allowing the agency to email certification decision letters and reflecting that the agency’s directory of certified businesses is now online.
The attached rule changes will take affect August 1, 2017.
