Published on 01/18/2019

The Service-Disabled Veterans Small Business Continuation Act (H.R. 5044) has recently passed the U.S. House of Representatives, though it has not yet passed the Senate. The bill was introducted by Rep. Steve Chabot (R-Ohio).

The bill provides that the surviving spouse of the owner of a Service Disabled Veteran Owned Small Business (SDVOSB) who had less than a 100% disability rating, as certified by the Department of Veterans Affairs (VA), shall, if the spouse retains ownership of the business, be allowed to keep the SDVOSB certification for the purpose of doing business with the VA, being considered the spouse of a 100% disabled veteran until one of three events, those being: the third anniversary of the veteran's death; the surviving spouse remarries; or the surviving spouse relinquishes control of the business.

The bill has been read in the Senate and referred to the Senate's Committee on Veterans' Affairs.
