SBA invites comment on rule eliminating SDVOSB self-certification

The U.S. Small Business Administration (SBA) has issued a direct "Final Rule" that eliminates self-certification procedures for service-disabled veteran-owned small businesses (SDVOSBs), in terms of whether such SDVOSBs can be counted towards federal SDVOSB participation goals. The final rule implements changes made by the National Defense Authorization Act for Fiscal Year 2024 (NDAA 2024).

The rule is currently slated to go into effect on August 5th, 2024, unless "significant adverse comment" is received from members of the public by July 8th, 2024. Should the rule go into effect, SDVOSBs would then need to ensure they are certified by the SBA by going through the new Veteran Small Business Certification (or VetCert) procedure (available at https://veterans.certify.sba.gov/).

Interested parties may submit comments on the final rule through the Federal eRulemaking Portal (at https://www.regulations.gov/), or through the physical mail by sending comments to: Donna Fudge, Office of Government Contracting and Business Development, U.S. Small Business Administration, 409 Third Street SW, Washington, DC 20416. Submissions must include the agency name (that being the SBA), and the docket number or Regulatory Information Number (RIN) for the rule (those being Docket No. SBA-2024-0003 or RIN 3245-AI10, respectively).
