Disadvantaged Business Enterprise Program (DBE) Requirements
The County is a recipient of federal financial assistance, and as such, must comply with all
elements of Title 49; Part 26 of the CFR entitled “Participation by Disadvantaged Business
Enterprises in Department of Transportation Financial Assistance Programs.” It is the policy
of the County to ensure that DBEs, as defined in Part 26, have an equal opportunity to receive
and participate in Department of Transportation assisted contracts.
The County has established a 20% participation goal for the participation of DBEs for this
solicitation. Consultants are required to submit a completed and signed “Consultant Proposal
DBE Commitment” form (Caltrans LAPM Exhibit 10-O1) as part of their SOQ. The
“Consultant Contract DBE Information” form (Caltrans LAPM Exhibit 10-O2) will be
project-specific and shall be submitted with the Consultant’s proposal response to each Mini-
RFP in the password protected or sealed cost proposal. This form should not be submitted
with this initial SOQ.
DBE requirements must be fulfilled by either documenting commitments to DBE firm
participation to meet the Contract goal or by documenting adequate good faith efforts to meet
the Contract goal. An adequate good faith effort requires the Consultant to show that all
necessary and reasonable steps were taken to achieve a DBE goal that, by their scope,
intensity, and appropriateness to the objective, could reasonably be expected to meet the
DBE goal. If the DBE goal has not been met, Consultant must complete and submit the
“Proposer/Contractor Good Faith Efforts” form (Caltrans LAPM Exhibit 15-H) with the
SOQ showing that you made adequate good faith efforts to meet the goal. Only good faith
efforts directed towards obtaining participation by DBEs will be considered.
Further detail regarding the DBE program may be found in the proposed agreement and the
“Notice to Proposers DBE Information” form (Caltrans LAPM Exhibit 10-I), both of which
can be found as part of Attachment A.
